The Assumption of Privacy

As if they knew we were just talking about this in class!
A Chinese couple is suing their local subway company because a security video of them kissing on a subway platform has been posted to YouTube. Do they have the right to assume that this is a private act (or that the film is private)? What about people who hold loud conversations about private things on their cell phones in line at the grocery store? Is there a difference between the two? What is the difference?
